Draft Law on Amendments to Article 201 of the Criminal Code of the Russian Federation

The Law Office of St. Petersburg "Main Letter" informs that Bill No. 102053-8 "On Amendments to Article 201 of the Criminal Code of the Russian Federation" has been submitted to the State Duma.
The purpose of the bill is to protect the interests and security of the Russian Federation, the rights and freedoms of citizens of the Russian Federation, the rights and legitimate interests of Russian legal entities.
The authors of the bill proceed from the fact that the introduction and compliance with sanctions by foreign states or unions of foreign states is the responsibility of these states and unions, as well as their officials. However, if someone inside the Russian Federation decides to restrict the rights and freedoms of citizens of the Russian Federation, legal entities, bodies or organizations, then such persons should bear criminal responsibility.
The draft federal law proposes to supplement the second part of Article 201 "Abuse of authority" of the Criminal Code of the Russian Federation with the qualifying feature "committed for the purpose of executing a decision of a foreign state, a union of foreign States or an international organization on the introduction of restrictive measures against the Russian Federation."
Thus, the use by a person performing managerial functions in a commercial or other organization of his powers contrary to the legitimate interests of this organization and for the purpose of extracting benefits and advantages for himself or other persons or harming other persons, if this act entailed causing significant harm to the rights and legitimate interests of citizens or organizations or the legally protected interests of society or States committed in order to comply with foreign sanctions will be qualified immediately under part two of Article 201 of the Criminal Code of the Russian Federation.
The commission of these acts will be punishable by a fine of up to one million rubles or in the amount of the convicted person's salary or other income for a period of up to five years or without it, or forced labor for up to five years with deprivation of the right to hold certain positions or engage in certain activities for up to three years or without it, or imprisonment for up to ten years with deprivation of the right to hold certain positions or engage in certain activities for up to three years.
