The relevant legal positions are laid down in the draft resolution of the plenum "On the application of the Arbitration Procedural Code of the Russian Federation when considering cases in the court of first instance." The document is currently being finalized.

Of course, the clarifications relate to arbitration processes. But similar norms are laid down in the Civil Procedure Code of the Russian Federation. So there is no reason to doubt: the same approaches will be extended to civil disputes.

"In case of disrespect on the part of the participants in the trial, the legislation provides for differentiated response measures - from criminal liability for insulting the participants in the process, which I mentioned earlier, to the appointment of a simplified court fine," Viktor Momotov, chairman of the Council of Judges of Russia, said at the time. - In addition, the legislation provides for the possibility of removing a participant in the process from the courtroom after giving him one warning."

Also, according to the chairman of the Council of Judges of Russia Viktor Momotov, the law allows, without removing the violator from the courtroom, to limit his time for speech, and in case of gross violations - to deprive him of speech.

"This will allow a more flexible approach to cases of violations of the order of conduct in court," says Viktor Momotov.
