The most interesting, in our opinion, is the legal position set out in paragraph 1 of the Review.
In this ruling, the Supreme Court of the Russian Federation for the first time established the procedure for repayment of the claims of collateral creditors of construction participants whose claims are not included in the register of claims for the transfer of premises.
This position of the Supreme Court of the Russian Federation is based on the decision of the Constitutional Court of the Russian Federation dated 21.07.2022.
